Proposed Tenancy Changes III – Retaliatory Notice

A definition of Retaliatory Notice from the Tenancy Services Website - Retaliatory notice’ is where a landlord gives notice to end a tenancy in retaliation for a tenant standing up for their rights as a tenant. A landlord must not issue a notice to end a tenancy in retaliation for any complaint against them relating to the tenancy. See more at www.tenancy.govt.nz 

The proposed amendment provides for strengthened enforcement together with an increased penalty of $2000 in exemplary damages. It is aimed at preventing landlords issuing a 90 day notice to end a tenancy in response to a tenant trying to enforce their rights.
